I will not draw NSFW or excess gore, but I can draw more mild content. I will draw fanart, real people, or original characters provided they meet this criterion.When you purchase a commission, you must agree to the terms outlined below.
Terms of ServiceYou, the commissioner ("the Client") agree to the terms written by Stars ("the Artist"), who operates under the handle @CofStars.The Client wishes to commission the Artist to create an original artwork (the "Artwork") according to the specifications and requirements agreed upon by both parties.The Artist agrees to provide the Artwork to the Client in exchange for a fee and subject to the following terms and conditions:1. Scope of Work
The Artist will create the Artwork based on the Client's description, preferences, and feedback. The Artist will deliver the Artwork in a digital format of the Client's choice within the agreed deadline, if provided. The Artist will retain the original files and source materials of the Artwork.2. Payment
The Client will pay the Artist a fee of [Amount] for the Artwork. The payment will be made in two installments: 50% upfront and 50% upon completion and delivery of the Artwork. The payment can alternatively be paid 100% upfront. The Artist will not start working on the Artwork until at least 50% of the payment is received.3. Revisions
The Artist will provide the Client with a sketch or a draft of the Artwork for approval before proceeding to the final stage, if requested. The Client may request up to one revision of the Artwork at no additional cost. Any additional revisions will incur a fee of [20% of commission price] per revision. The Artist will not make any changes to the Artwork after the final approval and delivery.4. Rights and Ownership
The Artist retains all rights, title, and interest in the Artwork, including the copyright and moral rights. The Client obtains a non-exclusive, non-transferable, and non-sublicensable license to use the Artwork for personal, non-commercial purposes only. If the Client wishes to use the Artwork commercially, the Client must alert the Artist upfront. Commerical use will require additional fees or payment. If the Client wishes to use the Artwork commercially later, the Client must contact the Artist and pay a royalty or fee in exchange for commercial use.The Client agrees to credit the Artist for the Artwork with the handle @CofStars whenever and wherever the Artwork is displayed or used. The Client will not edit out the Artist's signature or claim the Artwork as their own. The Client will not edit, alter, modify, or manipulate the Artwork in any way without the Artist's prior consent. The Client will not reupload, repost, distribute, or share the Artwork without the Artist's prior consent. The Client will not sell, resell, or license the Artwork to any third party without the Artist's prior written consent. The Client is allowed to display the Artwork as a profile picture or other personal uses without consent from the Artist, but the Client must still credit the Artist and is subject to the other terms in this agreement.The Artist reserves the right to display, publish, or promote the Artwork on their portfolio, website, social media, or other platforms, unless otherwise agreed upon by both parties in writing.5. Termination
Either party may terminate the commission at any time by giving a written notice to the other party. If the Client terminates the contract before the completion and delivery of the Artwork, the Client will forfeit the first installment and pay the Artist for any work done up to the date of termination. If the Artist terminates the contract before the completion and delivery of the Artwork, the Artist will refund the first installment and any work done up to the date of termination will belong to the Client. After the Artwork has been completed, the Client is still subject to the other terms on this page.6. Disclaimer
The Artist is not liable for any damages, losses, or liabilities arising from or related to the use or misuse of the Artwork by the Client or any third party. The Artist is not responsible for any infringement or violation of any laws, regulations, or rights by the Client or any third party in connection with the Artwork.7. Governing Law
This contract is governed by the laws of the United States, and any disputes arising from or related to this contract will be subject to the exclusive jurisdiction of the courts of the United States.8. Entire Agreement
This contract constitutes the entire agreement between the parties and supersedes any prior or contemporaneous agreements, understandings, or representations, whether written or oral, regarding the subject matter of this contract. This contract may not be modified or amended except by a written document signed by both parties.By ordering a commission, the Client agrees to all of the terms and conditions of this contract.
